YOU MAY BE ELIGIBLE FOR A MONETARY AWARD IF YOU WORKED FOR KIMCO STAFFING OR RYDER INTEGRATED LOGISTICS AT A MORENO VALLEY FACILITY BETWEEN MAY 2016 AND JUNE 2019.

On June 22, 2021, the U.S. District Court for the Central District of California approved the settlement of a race discrimination lawsuit brought by the U.S. Equal Employment Opportunity Commission (“EEOC”) against Defendants Ryder Integrated Logistics, Inc. (“Ryder”) and Kimco Staffing Services, Inc. (“Kimco”) (collectively, “Defendants”). In that lawsuit, the EEOC alleged that Defendants violated Title VII of the Civil Rights Act of 1964 and Title I of the Civil Rights Act of 1991 (“Title VII”) by subjecting Black employees working at 25300 Globe Street, Moreno Valley, CA 92551 to unlawful race discrimination, harassment and retaliation between May 2016 and the present.

The settlement, called a “Consent Decree,” provides for a total of $2 million dollars in monetary payments to a class of eligible Black workers who were adversely affected by race discrimination, harassment, and/or retaliation. Individuals who identify as Black, African American, Bi-Racial/Multi-Racial (Black or African American and any other race or ethnicity) and who worked for either Defendant at 25300 Globe Street, Moreno Valley, CA 92551 during the Claims Period from May 1, 2016 through June 30, 2019, may be eligible to receive a monetary award under the Consent Decrees.

You have been identified by Defendants as an individual who worked for Kimco or Ryder at 25300 Globe Street, Moreno Valley, CA 92551 during the Claims Period. Accordingly, you may be eligible to participate in the claims process and may be entitled to receive a monetary award under the Consent Decree.

YOU HAVE TWO OPTIONS:

1. Complete an online Claims Form at www.KimcoRyderSettlement.com no later than December 31, 2021. The EEOC will use this information to determine your eligibility to receive a settlement award and the amount of the award. Your responses must be provided under oath and penalty of perjury.

   The EEOC decides who is eligible to receive a monetary award and the amount of each award. The EEOC keeps none of the settlement money. If the EEOC determines you are eligible for a monetary award, you will be sent a notification letter, which will include a release of claims that you must sign and return to receive a monetary award. Monetary awards will be distributed as soon as possible beginning in 2022. Prior to receipt, you must notify the Claims Administrator if your contact information or mailing address changes.

2. Do nothing. By doing nothing, you will not receive any money from the settlement and will retain your right, if you have such a right, to sue Defendants at your own cost on claims that they violated Title VII by discriminating against you based on race.

In order to facilitate the settlement process, the EEOC is working with Claims Administrator Simpluris to collect information and distribute settlement funds. Please direct all questions regarding making a claim, filling out the claims form, and mailing of settlement checks to Simpluris at 888-369-3780. Please do not contact the Court or Defendants concerning the Claims Process.

The EEOC has sole discretion to determine your eligibility for a settlement award, the amount of any such award, and the timing of the award.
